TRANSFER OF ASSETS TO THE STATE LOCAL

DECREE May 28, 2010, No 85
Allocation to municipalities, provinces, cities' metropolitan regions and their own assets, pursuant to Article 19 of Law May 5, 2009, No 42. (10G0108)
THE PRESIDENT OF THE REPUBLIC

Having regard to Articles 76, 87, fifth paragraph, 117 and 119 of the Constitution, the law
Vista 5 May 2009, No 42, delegating the Government on fiscal federalism, in implementation of Article 119 of the Constitution, and in particular Article 19, relating to the assets of municipalities, provinces, cities' urban areas and regions;
Given the preliminary resolution of the Council of Ministers, adopted at its meeting on 17 December 2009;
Given the failure to achieve the Joint Conference of the arrangement in accordance with Article 3 of Legislative Decree 28 August 1997, No 281;
Given the favorable opinion of the State-city 'and local governments, expressed in Article 9, paragraph 6, letter c) of Legislative Decree 28 August 1997, No 281, at its meeting on 4 March 2010, agreed on the text during the same session;
Given the decision of the Council of Ministers, adopted at its meeting on March 12, 2010, approval of the report provided for in Article 2, paragraph 3, third and fourth period, the Law of 5 May 2009, No 42;
Given the report of the Parliamentary Commission for the implementation of fiscal federalism in Article 3 of Law May 5, 2009, No 42, and the opinions of the parliamentary committees responsible for the financial implications of the Chamber of Deputies and the Senate;
Given the decision of the Council of Ministers, adopted at its meeting on May 20, 2010;
On the proposal of the Minister ' Economy and Finance, the Minister for Reforms to federalism, the Minister for the simplification of legislation, the Minister for Relations with the Regions and the Minister for European policies, in consultation with the Minister and the Minister for Public Administration and Innovation;

the following legislative decree:

Article 1 Subject

1. In compliance with the Constitution with the provisions of this Decree and with one or more 'decrees of the President of the Council of Ministers have identified the state assets that can be attributed at no charge to municipalities, provinces, cities' and urban regions.
2. The local authorities which are attributed to the property are required to ensure maximum value functional.

Article 2
Parameters as assigning the assets

1. The State, subject to agreement reached by the Joint Conference, find the goods to be given at no charge to:
municipalities, provinces, cities 'urban areas and regions, according to criteria of territoriality,' subsidiarity ', adequacy, simplicity, capacity' financial relationship with powers and functions, as well as' enhancement of the environment, according to the provisions of Article 3.
2. Local authorities in a state of insolvency within the meaning of Article 244 of the consolidated laws on the local authorities, as per legislative decree of 18 August 2000 No 267, continues until a state of collapse, can not dispose of the assets allocated to them, which can be used only for purpose 'of an institutional nature.

4. 5. I beni statali sono attribuiti, a titolo non oneroso, a Comuni, Province, Citta' metropolitane e Regioni, anche in quote indivise, sulla base dei seguenti criteri:
a) sussidiarieta', adeguatezza e territorialita'. In applicazione di tali criteri, i beni sono attribuiti, considerando il loro radicamento sul territorio, ai Comuni, salvo che per l'entita' o tipologia del singolo bene o del gruppo di beni, esigenze di carattere unitario richiedano l'attribuzione a Province, Citta' metropolitane o Regioni quali livelli di governo maggiormente idonei a soddisfare le esigenze di tutela, gestione e valorizzazione tenendo conto del rapporto che deve esistere tra beni trasferiti e funzioni di ciascun livello istituzionale;
b) semplificazione. In applicazione di tale criterio, i beni possono essere inseriti dalle Regioni e dagli enti locali in processi di alienazione e dismissione secondo le procedure di cui all'articolo 58 del decreto-legge 25 giugno 2008, n. 112, convertito, con modificazioni, dalla legge 6 agosto 2008, n. 133. In applicazione di tale criterio la valorizzazione del bene e' realizzata avendo riguardo alle caratteristiche fisiche, morfologiche, ambientali, paesaggistiche, culturali e sociali dei beni trasferiti, al fine di assicurare lo sviluppo del territorio e la salvaguardia dei valori ambientali.

Art. 3
Attribuzione e trasferimento dei beni

1. Ferme restando le funzioni amministrative gia' conferite agli enti territoriali in base alla normativa vigente, con uno o piu' decreti del Presidente del Consiglio dei Ministri, su proposta del Ministro dell'economia e delle finanze, di concerto con il Ministro per le riforme per il federalismo, con il Ministro per i rapporti con le Regioni e con gli altri Ministri competenti per materia, adottati entro centottanta giorni dalla data di entrata in vigore del presente decreto legislativo:
a) sono trasferiti alle Regioni, unitamente alle relative pertinenze, i beni del demanio marittimo di cui all'articolo 5, comma 1, lettera a) ed i beni del demanio idrico di cui all'articolo 5, comma 1, lettera b), salvo quanto previsto dalla lettera b) del presente comma;
b) sono trasferiti alle Province, unitamente alle relative pertinenze, i beni del demanio idrico di cui all'articolo 5, comma 1, lettera b), limitatamente ai laghi chiusi privi di emissari di superficie che insistono sul territorio di una sola Provincia, e le miniere di cui all'articolo 5, comma 1, lettera d), che non comprendono i giacimenti petroliferi e di gas e le relative pertinenze nonche' i siti di stoccaggio di gas naturale e le relative pertinenze.
2. 3. Salvo quanto previsto dai commi 1 e 2, i beni sono individuati ai fini dell'attribuzione ad uno o piu' enti appartenenti ad uno o piu' livelli di governo territoriale mediante l'inserimento in appositi elenchi contenuti in uno o piu' decreti del Presidente del Consiglio dei Ministri adottati entro centottanta giorni dalla data di entrata in vigore del presente decreto legislativo, previa intesa sancita in sede di Conferenza Unificata ai sensi dell'articolo 3 del decreto legislativo 28 agosto 1997, n. 281, su proposta del Ministro dell'economia e delle finanze, di concerto con il Ministro per le riforme per il federalismo, con il Ministro per i rapporti con le Regioni e con gli altri Ministri competenti per materia, sulla base delle disposizioni referred to in Articles 1 and 2 of this decree. 4. 6. Art. 4
Status dei beni

1. I beni, trasferiti con tutte le pertinenze, accessori, oneri e pesi, salvo quanto previsto dall'articolo 111 del codice di procedura civile, entrano a far parte del patrimonio disponibile dei Comuni, delle Province, delle Citta' metropolitane e delle Regioni, ad eccezione di quelli appartenenti al demanio marittimo, idrico e aeroportuale, che restano assoggettati al regime stabilito dal codice civile, nonche' alla disciplina di tutela e salvaguardia dettata dal medesimo codice, dal codice della navigazione, dalle leggi regionali e statali e dalle norme comunitarie di settore, con particolare riguardo a quelle di tutela della concorrenza. Ove ne ricorrano i presupposti, il decreto del Presidente del Consiglio dei Ministri di attribuzione di beni demaniali diversi da quelli appartenenti al demanio marittimo, idrico e aeroportuale, puo' disporre motivatamente il mantenimento dei beni stessi nel demanio o l'inclusione nel patrimonio indisponibile. Per i beni trasferiti che restano assoggettati al regime dei beni demaniali ai sensi del presente articolo, l'eventuale passaggio al patrimonio e' dichiarato dall'amministrazione dello Stato ai sensi dell'articolo 829, primo comma, del codice civile. Sui predetti beni non possono essere costituiti diritti di superficie.
2. Il trasferimento dei beni ha effetto dalla data di pubblicazione nella Gazzetta Ufficiale dei decreti del Presidente del Consiglio dei Ministri di cui all'articolo 3, commi 1 e 4, quarto periodo. Il trasferimento ha luogo nello stato di fatto e di diritto in cui i beni si trovano, con contestuale immissione di ciascuna Regione ed ente locale nel possesso giuridico e subentro in tutti i rapporti attivi e passivi relativi ai beni trasferiti, fermi restando i limiti derivanti dai vincoli storici, artistici e ambientali.
3. I beni trasferiti in attuazione del presente decreto che entrano a far parte del patrimonio disponibile dei Comuni, delle Province, delle Citta' metropolitane e delle Regioni possono essere alienati solo previa valorizzazione attraverso le procedure per l'adozione delle varianti allo strumento urbanistico, e a seguito di attestazione di congruita' rilasciata, entro il termine di trenta giorni dalla relativa richiesta, da parte dell'Agenzia del demanio o dell'Agenzia del territorio, secondo le rispettive competenze.

Art. 5
Tipologie dei beni

1. I beni immobili statali e i beni mobili statali in essi eventualmente presenti che ne costituiscono arredo o che sono posti al loro servizio che, a titolo non oneroso, sono trasferiti ai sensi dell'articolo 3 a Comuni, Province, Citta' metropolitane e Regioni sono i seguenti:
a) i beni appartenenti al demanio marittimo e relative pertinenze, come definiti dall'articolo 822 of the Civil Code and Article 28 of the Navigation Code, excluding those directly used by central governments;
b) the property belonging to public water and related works, as well as' water supply works and remediation under state jurisdiction, as defined in Articles 822, 942, 945, 946 and 947 of the Civil Code and special laws for the sector, excluding:
1) the rivers of supra-regional context;
2) supra-Lakes area for which no invitation an agreement between the regions concerned, subject to any discipline, however, the international level;
c) the airports of regional or local interest belonging to State Aircraft State civil and related works, other than those of such national interest 'as defined in Article 698 of the Navigation Code
d) mines and related appurtenances located on the mainland;
e) other property of the State , except those excluded from the transfer.
2. Except as provided in subsection 4, shall in any event excluded from the movement: properties in proven and effective use for purpose 'to the institutional authorities of the State, including an autonomous public bodies recipients of property of the state government use and Agencies referred to in Legislative Decree 30 July 1999, No 300, as amended, ports and airports economic importance nationally and internationally, in accordance with the regulations for the sector; the cultural treasures, except as provided by law and by paragraph 7 of this Article, the goods under agreements or arrangements with local authorities to rationalize or enhancement of their real estate assets signed on the date of entry into force of this Decree and networks at the state, including the road and energy, the railroads are using the property 'of the State, shall also be' excluded from the transfer of this Decree of the national parks and state nature reserves. 3. 4. Within one year from the date of entry into force of this decree by the President of the Council of Ministers, upon proposal of the Minister of Defence, in consultation with the Minister of Economy and Finance and the Minister for reforms for federalism, by agreement enshrined in the Joint Conference pursuant to Article 3 of Legislative Decree August 28, 1997, No 281, are identified and assigned the property still in use at the Ministry of Defence which may be transferred pursuant to paragraph 1, because not included in those used for the functions of defense and national security, not subject to the procedures laid down ' Article 14-bis of Decree-Law of 25 June 2008, n. 112, ratified with amendments by Law 6 August 2008, No 133, referred to in Article 2, paragraph 628, of Law December 24, 2007, No 244 of Law December 23, 2009, No 191, as well as' not for carrying out the reorganization of the military programs aimed at the effective and efficient exercise of those functions through the specific means approved al Ministero della difesa dalla normativa vigente.
5. In sede di prima applicazione del presente decreto legislativo, nell'ambito di specifici accordi di valorizzazione e dei conseguenti programmi e piani strategici di sviluppo culturale, definiti ai sensi e con i contenuti di cui all'articolo 112, comma 4, del codice dei beni culturali e del paesaggio, di cui al decreto legislativo 22 gennaio 2004, n. 42, e successive modificazioni, lo Stato provvede, entro un anno dalla data di entrata in vigore del presente decreto, al trasferimento alle Regioni e agli altri enti territoriali, ai sensi dell'articolo 54, comma 3, del citato codice, dei beni e delle cose indicati nei suddetti accordi di alorizzazione.
6. Nelle citta' sedi di porti di rilevanza nazionale possono essere trasferite dall'Agenzia del demanio al Comune aree gia' comprese nei porti e non piu' funzionali all'attivita' portuale e suscettibili di programmi pubblici di riqualificazione urbanistica, previa autorizzazione dell'Autorita' portuale, se istituita, o della competente Autorita' marittima.
7. Sono in ogni caso esclusi dai beni di cui al comma 1 i beni costituenti la dotazione della Presidenza della Repubblica, nonche' i beni in uso a qualsiasi titolo al Senato della Repubblica, alla Camera dei Deputati, alla Corte Costituzionale, nonche' agli organi di rilevanza costituzionale.

Art. 6
Valorizzazione dei beni attraverso fondi comuni di real estate investment

1. 2. La Cassa depositi e prestiti, secondo le modalita' di cui all'articolo 3, comma 4-bis, del decreto-legge 10 febbraio 2009, n. 5, convertito, con modificazioni, dalla legge 9 aprile 2009, n. 33, puo' partecipare ai fondi di cui al comma 1.
3. Agli apporti di beni immobili ai fondi effettuati ai sensi del presente decreto si applicano, in ogni caso, le agevolazioni di cui ai commi 10:11 Article 14-bis of Law January 25, 1994, No 86.

Article 7
Decrees biennial award

1. Article 8
Optimum use of public goods by local authorities

1. Article 9 Final provisions

1. All deeds, contracts, formality 'and other implications for the implementation of this Decree shall be exempt from all rights and duties.
2. Alle procedure di spesa relative ai beni trasferiti ai sensi delle disposizioni del presente decreto non si applicano i vincoli relativi al rispetto del patto di stabilita' interno, per un importo corrispondente alle spese gia' sostenute dallo Stato per la gestione e la manutenzione dei beni trasferiti. Tale importo e' determinato secondo i criteri e con le modalita' individuati con decreto del Presidente del Consiglio dei Ministri, su proposta del Ministro dell'economia e delle finanze, da adottarsi entro sessanta giorni dalla data di entrata in vigore del presente decree. Each region or local authority can 'make sale of real estate assigned under this Decree after confirmation of the adequacy' of the value of the property by the State Property Agency or of the land in accordance with their skills.
